CaterZen Referral Program

Terms and Conditions

Sponsored by CaterZen by Restaurant and Catering Systems. Open to legal residents of the United States who are 18 years of age or older, have a valid U.S. driver’s license and a valid U.S. Social Security number or Tax Identification Number. Void where prohibited. Odds of winning dependent upon the number of eligible entries received during the Contest Period. The Contest is administered by CaterZen and any questions, comments or complaints regarding the Contest must be directed to the contest administrator. Entrant acknowledges that any information provided will be used for administering the Contest. Not be combined with any other offers, CaterZen reserves the right to change the conditions of this offer at any time without notice.

Prize: A Royal Caribbean cruise will be awarded to one (1) winner. The winner will receive a cruise booking up to $5000.

WINNER IS RESPONSIBLE FOR PAYING ALL OTHER COSTS WHILE ABOARD THE CRUISE, TO AND FROM THE CRUISE, AND AT ANY PORTS.

Prizes are not transferable or exchangeable by the winner to any other entrant. The prize must be redeemed from CaterZen, or its representative within 7 days of the contest Giveaway Event. If the prize cannot be awarded for any reason, CaterZen reserves the right to substitute such prize with another prize of equal or greater value, as determined by CaterZen in its sole discretion.

One entry per person per qualified referral who becomes a paying CaterZen customer to qualify for an entry to the drawings.

Entry Eligibility: Open to participants 18 and over. Owners of CaterZen, their agents, and employees are prohibited from participating in the Contest.

Entrants into the Royal Caribbean cruise drawing will be deemed to have accepted these Terms and Conditions. No purchase is necessary to win. Odds of winning are the number of referrals sent in that become customers, divided by the allowable entrants. There must be at least 50 entrants.

Referred client must be an active client of CaterZen and with an ongoing subscription to CaterZen’s services at the time of drawing.

Contest Period: The contest period will begin on January 1, 2019, and continue until the Close Date. The Close Date of the drawings is the date which CaterZen determines there are 50 qualified referrals in the program not to exceed 12 months. One winner will be chosen from a random draw of entries received in accordance with these Terms and Conditions. The draw will be performed by a random computer process.

If there are not 50 qualified referrals within the close of the promotion twelve (12) months, then CaterZen will take the number of qualified referrals and multiply it by $100 and use that dollar amount for the drawing as prize for the random referrer picked.

[Promotional Activity: The winner may be required to take part in promotional activity related to the Prize Draw and the winner shall participate in such activity on CaterZen's reasonable request. The winner consents to the use by CaterZen and its related companies, both before and after the closing date of the Prize Draw for an unlimited time, of the winner's voice, image, photograph and name for publicity purposes (in any medium, including still photographs and films, and on the internet, including any websites hosted by CaterZen and its related companies) and in advertising, marketing or promotional material without additional compensation or prior notice and, in entering the Prize Draw, all entrants consent to the same.]

By entering the Prize Draw, you agree to the collection, retention, usage and distribution of your personal information in order to process and contact you about your Prize Draw entry, and for the purposes outlined above.

Modification/Termination of Contest: CaterZen reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Prize Draw with or without prior notice due to reasons outside its control (including, without limitation, in the case of anticipated, suspected or actual fraud). The decision of CaterZen in all matters under its control is final and binding and no correspondence will be entered into.

Acceptance of Prize: By accepting the prize, Winner agrees to the prize conditions on participation and must sign a release to be eligible to receive the prize and hereby agrees: (i) that all decisions of CaterZen, and Contest Entities with respect to the Contest are final and binding; (ii) to release CaterZen and its respective parent companies and affiliates, officers, directors, employees, agents, and licensees from any and all claims in connection with the Contest and the award or use of the prize; (iii) to allow CaterZen to use their names, voices, photographs, likenesses, biographical material, in any advertising or broadcasting material relating to this contest, without additional financial or other compensation; and (iv) where allowed by law, sign a publicity release confirming such consent prior to acceptance of the prize. All other costs and expenses related to prize acceptance and use not specified herein as being provided are the sole responsibility of Prize winner. CaterZen is not responsible in any manner for, any warranties, representations, or guarantees, express or implied, in fact or law, relating to any prizes, regarding the use, value or enjoyment of the prize, including, without limitation, its quality, mechanical condition, or fitness for a purpose. CaterZen will not have any further obligation to winner. All taxes, upgrades and any other expenses not specifically identified in these Official Rules as included in the prize are the responsibility of the winner. CaterZen reserves the right to substitute a prize, in whole or in part, of equal or greater monetary value if a prize cannot be awarded, in whole or in part, as described for any reason.

CaterZen shall not be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.

Tampering and Delivery Disclaimer CaterZen, in its sole discretion, reserves the right to disqualify and prohibit from participating any person, who CaterZen determines (in its discretion) is or is attempting to: (i) tamper with any part of the Contest; (ii) attempting to undermine the legitimate operation of the Contest by cheating, deception, or other unfair playing practices, (iii) intending to annoy, abuse, threaten or harass any other participants, agents or representatives of CaterZen; and/or (iv) otherwise violating these Official Rules.

Other Prize and Tax Information: There will be a $250.00 check awarded via mail upon a new client acquisition acquired from a referral. Check paid to the referrer. Distributions from CaterZen will happen quarterly. If you receive more than one payout annually you will need to complete a IRS Form W-9 and CaterZen will send you a IRS Form 1099 for tax purposes.

Release By participating in the Contest, each participant and winner holds harmless and waives any and all claims of liability or damages against CaterZen and their respective employees and agents, for any personal injury or any loss which may occur from the conduct of, or participation in, the Contest, or from the award, receipt and/or use or misuse of any prize, including any travel related thereto. In order to participate in the giveaway event or to receive a prize, participants must sign an official waiver form provided by CaterZen.

Compliance with Law: BY ENTERING THE CONTEST, PARTICIPANTS HEREBY SUBMIT TO THE JURISDICTION AND VENUE OF THE FEDERAL AND STATE COURTS OF TENNESSEE, COUNTY OF DAVIDSON, AND WAIVE THE RIGHT TO HAVE DISPUTES ARISING OUT OF THIS CONTEST ADJUDICATED IN ANY OTHER FORUM. IN NO EVENT WILL PARTICIPANT BE ENTITLED TO INJUNCTIVE OR EQUITABLE RELIEF OF ANY KIND, OR RESTRAIN THE CONTINUATION OF ANY CONTEST.

Liability: In consideration of entering and/or attending the Giveaway, I release CaterZen, its owners, affiliates, employees and agents from any and all claims I, or my agents or assigns may every have, including but not limited to tort, common law and contract claims, other than any express contractual obligations of CaterZen as expressly set forth in the contest rules.
